Any person participating in any services that are offered by TennisGEN understands to have consented to all Terms and Conditions Below.

By signing accepting these terms and conditions, I hereby authorise the staff of TennisGEN to act for me according to their best judgment in any emergency requiring medical attention. I release TennisGEN from any and all liability for injury or illness and costs, incurred while undertaking a program or event with TennisGEN. I agree to TennisGEN’s make up, cancellation and privacy policy. Photographs and Video make be taken and used in promotions by TennisGEN.

Medical & Liability

I hereby authorise the staff of TennisGEN to act for me according to their best judgment in any emergency requiring medical attention. I release TennisGEN from any and all liability for injury or illness and costs, incurred while undertaking a program or event with TennisGEN.

Photography & Video Images

I acknowledge that TennisGEN may film, use video analysis and photography during programs, lessons and events.
I acknowledge and agree that this usage, including for marketing & promotion purposes, is without compensation or notice to myself. Images may be used on our website, social media and other promotional material. Any reference to “TennisGEN” will include and not limited to its business, director/s, employees, consultants and staff. When referring to “physical activity” includes and not limited to exercise sessions with a TennisGEN employee, i.e a cardio tennis, private coaching, group coaching, use of all facilities and equipment that are provided to the participant by TennisGEN. It is the responsibility to inform their personal family advisor regarding their intent to participate in program events and scheduling, and it is understood that the participant does so under accordance with medical practitioner advice. TennisGEN shall not be responsible for any injuries sustained directly or indirectly to themselves or any person during or after the Program. The client is aware and acknowledges that the program and any exercises can carry risks associated with injury and that shall not be the responsibility of TennisGEN as a result of any injuries. The Client acknowledges that is it their personal responsibility to inform their medical practitioner prior to engaging in any programming with TennisGEN. The Client acknowledges that during programming some physical contact may occur between the Client and some members of the TennisGEN and other members of the program and consents to that contact being made. The Client acknowledges that they are responsible for any damage caused to facilities or equipment of TennisGEN as a result of their wilful act or negligence.

First Time Enrollment

To confirm your preferred lesson time and group please complete an enrolment form and the team at TennisGEN will respond to your application within 3 days to confirm your spot for the term.

Re-Enrollment For Following Term

All current participants that are enrolled in TennisGEN lesson will be given priority in the following term. Here are TennisGEN we provide the opportunity for all participants to enter the same day or time slot. To ensure that the enrolment is successful, the payment for the term must be made by the selected due date. It is advised that if a participant would not like to continue further lessons, to let the program director know as quickly as possible. PLEASE NOTE: That if a participant is having payment issues, to let the program director know as quickly as possible. If the payment is not received by the upcoming due date, then participant position in the program may be lost.

Annual Re-Enrollment

Participants acknowledge that they are required to re-enrol each year to provide updated details. Participants that would like to change days or programming days must first contact program director prior to re-enrolling.

Payment For Lessons

Payment for Tennis lessons must be made to TennisGEN e.g. before beginning of tennis lesson. You may make payment for the Services (the ' Services Fee') by way of: a) Electronic funds transfer(' EFT ') into our nominated bank account; b) Cheque (' Cheque'); or c) Any other method as agreed with TennisGEN. You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee. You agree and acknowledge that TennisGEN can vary the Services Fee at any time. From time to time TennisGEN vary prices to take account of, amongst other things, any change in the cost of providing the goods and services. This will no affect services that have been purchased prior to change. All prices quoted for goods and services include GST, unless otherwise specified.

Make Up Lessons Or Refund

The participant acknowledges that if they are away for any reason it is their responsibility to inform TennisGEN in advance either via phone call or email. This will allow the participant to make up the lesson. This will entitle the participant to make up the lesson.
• Make up lessons can be used on an alternate day of the week. • Refunded for missed classes are not given as the spot has been secured for the duration of the term. If the participant has extended illness, injury or holiday please discuss this with the program director at TennisGEN. Missed classes will be agreed upon prior to lesson cancellation with TennisGEN director. A maximum of 2 make-up lessons are permitted per term based upon extended illness, injury or holiday. Make-up lessons are not transferable to other terms or participants.

Payment & Reservation For Classes

Term payment must be received by date to be confirmed in the program. The selected spot is held for the participant, if you require to change the day or time for the next term, please contact TennisGEN prior to payment due date. If after payment, participant is required to change times or days please contact the Program Director immediately. TennisGEN will try to accommodate your preferred time or day, however if classes are full, then participant must remain with original time and day. In the event that a participant/customer being default of their obligation to pay an overdue account then it will be referred onto a debt collection agency, and/or law firm for collection. The customer shall be liable for the recovery costs incurred and if the agency charges commissions on a contingency basis the customer shall be liable to pay a liquidated debt, the commission payable but he supplier to the agency, fixed at the rate charged by the agency from time to time as if the agency has achieved one hundred per cent recovery and in the event where the supplier or the supplier’s agency refers to the overdue account to a lawyer the customer shall also pay as a liquidated debt the chargers reasonably made or claimed by the lawyer, not an indemnity basis.

Changing Program

From time to time TennisGEN may feel that participants may benefit to moving to a different group of varying ability, clients will be contacted to discuss such options. TennisGEN may also need to change the coaches in the programs for various scheduling reasons, we will do our best to maintain communication if this occurs.

Credit Policy

Credit may be available in extenuating circumstances but will not be considered within 7 days of any school term starting. Lessons are non-refundable.

Private & Semi-Private Coaching Policy

Lessons that are cancelled by TennisGEN will be made up at a mutual time agreed upon between both parties. All private coaching cancellations made by a participant will be made up upon a mutually agreed time between the parties. Semi-private coaching, if both participants cancel with more than 24 hours notice a make-up lesson will be made at a time mutually agreed between the parties, in the case one pupil is to miss, no makeup lesson will be offered as the session still goes ahead with other pupil regardless. All cancellations made by a participant, with less that 24 hours notice, will be charged as if the lesson took place. However, TennisGEN may provide and consider the option another family member having the lesson.

Weather Policy

TennisGEN is dedicated to providing a duty of care to all participants which at times we may need to cancel lessons. TennisGEN will do everything possible to make the courts available for play, however as soon as TennisGEN understand that the conditions are not safe for use we may need to send a SMS [ideally] 60 minutes before lessons are due to begin. Flooded courts & extreme heat (37+ degrees) are examples of situations in which lessons may be abandoned. If you have not been contacted please assume that the lesson is continuing unless indicated otherwise by TennisGEN. Please do not call. Lessons cancelled due to weather will be made up at the end of the term. The commitment from TennisGEN is that TennisGEN everything possible to make the courts available for play, however as soon as TennisGEN know the courts are not safe for use, you will be sent a text message to postpone the coaching lesson. If you have not heard from us please always assume the lesson is on. Please do not call us. Updates via coaching Facebook account will also be made to provide further information, it is recommended that the participant check this form of media.

Disclaimer

The Client acknowledges that TENNISGEN has the right to update or vary the program, cancel, including but not limited to timing, venue, terms, prices, feeds, format or instructors in relation to all its services with notices at its sole discretion. The Client acknowledges and accepts all the conditions contained herein, and forever releases, discharges and indemnifies TennisGEN from any loss caused to any party in relation to a claim regarding to the breach of these Terms and Conditions. The Client agrees to any official photography, and use of images by TennisGEN for professional purposes. Written notification must be given should you not give consent to any form of photography.

Use Of Personal Information

As part of the registration process, or as part of your continued use of the Services, you are required to provide personal information about yourself (such as identification or contact details), including: (a) Full name of tennis player (b) Parent/guardian name and contact details (if player is under 18) (c) Date of Birth (d) Playing Level (e) Medical Conditions (f) Email address (g) Telephone number (h) Address You warrant that any information you give to TennisGEN in the course of completing the registration process will always be accurate, correct and up to date. This includes the provision of correct emergency contact details. TennisGEN will only store information relevant for coaching and billing purposes and this is only accessible but the program director and administration staff. TennisGEN will never share private information with a third party or advertising agency.

Variations Of Terms

TennisGEN reserves the right to review and change any of the Terms by updating this page at its sole discretion. When TennisGEN updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.

Governing Laws

The Terms are governed by the laws of Victoria, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Victoria, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.
